A bench of Justices BR Gavai and PS Narasimha dismissed the PCI's appeal and said its resolution was like executive instructions and hence it could not curtail the sweep of Article 19(1)(g) of the Constitution, which conferred a fundamental right on a person to establish an educational institution.
